Terms of Service

Last updated: October 7, 2026

These terms are an agreement between you (the business or person who signs up) and Shamrock Market Inc., which operates CallsKept (“CallsKept”, “we”, “us”). By ticking the box at sign-up and creating an account you agree to them.

1. The service

CallsKept gives your business a phone number that texts back missed callers, answers texts with AI, and — on Pro and Elite plans — answers calls with an AI voice receptionist, transfers calls, takes messages and books appointments. Features depend on your plan. Text messaging on a newly assigned number starts once phone carriers approve it; calls work right away.

2. Free trial and automatic renewal

3. Cancel online, anytime

You can cancel online in your workspace under Plans & billing → Cancel subscription — no phone call or email needed. You keep access until the end of the trial or paid period and won’t be charged again. Payments already made are not refunded except where required by law. Your CallsKept number may be released 30 days after your subscription ends unless you’ve asked us to port it out.

4. Your data, export and deletion

You own your contacts, messages and business information. You can download a copy at any time (Account settings → Your data → Download my data) and permanently delete your account and its data (Account settings → Delete account). We process your callers’ information on your behalf under our Data Processing Addendum, which forms part of these terms. See our Privacy Policy.

Text messaging program (SMS terms)

Program name: CallsKept business text messaging. Description: when you call or text a business that uses CallsKept and your call is missed, the business’s CallsKept number may send you a text reply so you can continue the conversation by text; further messages are replies about your request (for example hours, availability, appointment confirmations). We never send marketing messages and never text people who haven’t contacted the business first.

5. Your responsibilities

6. AI features

Replies and calls are generated by AI and can occasionally be wrong. Review your business information, greeting and settings, and don’t rely on the AI for medical, legal, financial or emergency advice to callers. You can turn AI features off at any time. We do not use your data or your callers’ data to train AI models.

7. Availability

Our service-level commitment is described on our Service levelsTexting consent page. Phone and text delivery also depend on phone carriers and other providers outside our control.

8. Limitation of liability

The service is provided “as is” without warranties beyond those in these terms and our Service levels page. To the extent allowed by law: (a) our total liability for all claims relating to the service is limited to the amount you paid us in the 3 months before the claim; and (b) we are not liable for lost profits, lost business, or indirect, incidental or consequential damages. Nothing in these terms limits liability that cannot be limited by law.

9. Intellectual property

We own the CallsKept software, site and brand. You keep ownership of your content and give us permission to use it only to provide the service to you. We won’t use your business name or logo in our marketing without your written permission.

10. Suspension

We may suspend or close accounts that break these terms, create legal or carrier risk, or don’t pay. Where possible we’ll tell you first and give you a chance to fix the problem.

11. Changes

We may update these terms. If a change is significant we’ll email you at least 14 days before it takes effect.

12. Governing law

These terms are governed by the laws of the State of New York, USA.
